Without limiting the foregoing, under no circumstances shall The Owners or its licensors be held liable for any direct or indirect loss or damage resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including but not limited to and without limitation, network failures, computer equipment failures, telecommunication equipment failures, other equipment failures, data loss, security breach, electrical power failures, strikes, labour disputes, riots, insurrections, civil disturbances, shortages of labour or materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in heat, light, or air conditioning.

In any event, the total liability of The Owner will not exceed the amount paid for The Service. Refunds of fees will only be issued in exceptional circumstances at the discretion of The Owner.

Indemnity

As a condition of use of The Site, you agree to indemnify MyFreeLodgings.com, The Owner, its officers, employees and agents from and against any and all liabilities, expenses (including attorneys' fees) and damages arising out of claims resulting from your use of The Service.

Termination

Subscriptions will terminate at the end of the pre-paid term unless renewed by timely payment of the appropriate fee. Upon termination of a subscription, all data associated with that subscription may be permanently deleted. The Owners will endeavour to remind the account holder prior to the end of the pre-paid term.

The management of The Service reserve the right, at its sole discretion, and for any reason, to alter, suspend or terminate any part of the service or of these Terms and Conditions, either globally or specifically in relation to one or more subscribers.

Changes in Terms and Conditions and Services

We reserve the right to modify these Terms and Conditions from time to time without notice, including the right to terminate with or without notice, without liability to you, any other user or any third party. Please review these Terms of Service from time to time so that you will be apprised of any changes.

Jurisdiction

These Terms and Conditions will be governed by and construed in accordance with the laws of the England, without giving effect to its conflict of laws provisions or your country of residence. If for any reason a court of competent jurisdiction finds any provision or portion of the Terms of Service to be unenforceable, the remainder of the Terms of Service will continue in full force and effect.
